Arkansas lien and payment bond deadlines: 10 days' notice, 120 days to file, 15 months to sue
Arkansas lien claimants give the owner 10 days' notice, file within 120 days of their last work and sue within 15 months. Public jobs over $50,000 carry a payment bond.
Arkansas's lien law for contractors, subcontractors and suppliers is in Title 18, Chapter 44 of the Arkansas Code. This is a summary, not legal advice.
Before filing
A claimant must give the owner at least 10 days' notice before filing a lien (Ark. Code § 18-44-114).
Filing the lien
The lien account must be filed with the clerk of the circuit court of the county where the property is located within 120 days after the materials were furnished or the work was performed, with an affidavit showing notice was given (§ 18-44-117).
Enforcing
A lawsuit to enforce the lien must be filed within 15 months after the lien is filed, and the claimant should record a lis pendens (§ 18-44-119).
Public jobs
Liens do not attach to public property. Instead, a public construction contract over $50,000 requires a payment bond in the amount of the contract (§ 18-44-503). Read the bond for its notice and claim terms.
